Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of the website at shambroomapps.com (“the site”), operated by Jonathan Shambroom, trading as Shambroom Apps, an individual based in Larkspur, California, United States (“we”, “us”, “I”).

By using the site or making a donation through it, you agree to these Terms. If you do not agree with them, please do not use the site.

2. What this site is

The site is an index of a small number of free web applications built by the operator. Its purpose is to describe those apps and link to them, explain how to add them to a phone’s home screen, and accept voluntary donations towards running costs.

The site itself does not host the apps, require an account, or sell anything. The apps are separate products, on their own domains, each governed by its own terms.

You may browse the site freely. To make a donation you must be at least 18 years old (or the age of majority where you live) and be using a payment method you are authorised to use.

Donations made through this site are voluntary gifts towards the cost of hosting and running the apps. Specifically:

6. Payment processing by Stripe

Payments are processed by Stripe, Inc. and its affiliates, an independent third-party payment processor. When you donate, you are taken to a payment page hosted by Stripe, and your card details are submitted directly to Stripe. We never receive or store your full card details.

Your use of Stripe’s payment page is additionally subject to Stripe’s own terms and privacy policy. We are not responsible for Stripe’s services, availability, or decisions — including a decision to decline or reverse a payment.

Charges will appear on your statement as SHAMBROOM DONATION (for Shambroom Apps).

7. Refunds

Because a donation is a voluntary gift and nothing is delivered in exchange for it, donations are generally non-refundable.

As a matter of practice, and without creating an obligation to do so in any other circumstance, we will refund a donation in full if you email jshambroom@gmail.com within 30 days of the payment and:

Please include the date and amount so the payment can be found. Refunds are returned to the original payment method. Your bank may take several business days to post the credit, and any currency-conversion difference is set by your bank, not by us.

If you believe a charge is fraudulent, please contact us before raising a chargeback — it is almost always faster.

8. Intellectual property

The site’s design, text, layout, and graphics are owned by the operator and are protected by copyright and other applicable laws. App names and icons shown on the site identify the operator’s own apps.

You may view, link to, and share the site. You may not copy, reproduce, or republish substantial parts of it, or present it as your own, without written permission. “Stripe” and other third-party names and marks referred to on the site belong to their respective owners and are used only to identify those services.

9. Content you submit

If you submit an email address, an app request, or any other message, you confirm the information is yours to give and is not unlawful. You grant us permission to use what you send for the purpose you sent it — to contact you, and to consider your suggestion.

Ideas or suggestions you send are given voluntarily and without obligation on our part: we may act on them, ignore them, or build something similar independently, with no compensation owed to you and no confidential relationship created. We may delete anything you submit at any time.

10. Third-party links and services

The site links to apps and to third-party services including Stripe. We do not control those sites and are not responsible for their content, availability, terms, or privacy practices. Following a link is at your own risk.

11. Disclaimers and no warranties

The site is provided “as is” and “as available”, free of charge. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the site will be uninterrupted, timely, secure, error-free, or that any defect will be corrected. Apps listed here may be changed, moved, or discontinued at any time.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of the site — whether based in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the site or these Terms will not exceed the greater of (a) the total amount you donated through the site in the twelve months before the claim arose, or (b) US$100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the above exclusions and limitations apply only to the extent permitted, and nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence, where such a limitation is not permitted by law.

13. Indemnification

You agree to indemnify and hold harmless the operator from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your misuse of the site, your breach of these Terms, or your violation of any law or of anyone else’s rights.

14. Suspension and termination

We may restrict or block access to the site, or refuse or reverse a donation, at any time and without notice, where we reasonably believe these Terms have been breached or that doing so is necessary to prevent fraud, abuse, or harm. Sections that by their nature should survive — including sections 8, 11, 12, 13, and 16 — survive any termination.

15. Changes to the site and to these Terms

The site is a personal project and may be changed, paused, or taken down at any time, without notice, and with no liability to you.

These Terms may be updated from time to time. The current version is always at shambroomapps.com/terms, and the “last updated” date at the top will change when they are revised. Continuing to use the site after a change means you accept the revised Terms. Changes are not applied retroactively to a donation already made.

16. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. the state and federal courts located in California, United States will have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction.

If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection laws of the country where you live.

17. Severability and entire agreement

If any provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. A failure to enforce any provision is not a waiver of it.

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the site.
